The translation of the patent documents are not only required with respect to the understanding prior art document before embarking on drafting, but also while responding to office action or Examination reports. Only when the document is translated will the response be of satisfactory nature. Also, the translation of patent applications from other languages finds itself useful while instituting infringement proceedings and defending infringement proceedings before the Patent office in the form of Oppositions and before the Courts in the form of suits.
Translations are of particular importance with respect to the European Union as the law mandates the European Patent Validation in the member countries of the European Union. IN order to validate a European Patent, one has to file the patent in the language that is acceptable by the patent Office of the respective Country. The European Office allows for a choice of around 5 languages in which patents are filed. However, when they enter into the national phases, there is a requirement that the patents be translated in to into the acceptable regional languages of the respective patent offices.
One strategy that an Applicant in the European Union may adopt, keeping in mind that they may have to have multiple applications in different languages that may be filed in the different countries is to have the first or base application drafted in English and comprehensively. That base application may then be used to translated in to the respective local language applications at the time of entry to the countries. This will also be cost effective as while responding to office actions, one will not find themselves in a position of lack of subject matter in the Application to defend the Application. This coupled with a human assisted machine translation along with a review of a patent specialist or attorney, produces quality translated applications. These patent applications retain the quality and the strength in which it was intended to be drafted the first time.
